Impasse

Went to mediation today and what a joke...

I am not supposed to talk about the details as it is all "confidential", i.e. "what happens in mediation stays in mediation" sort of like Las Vegas, I guess.

But I will say that the only offer the defense actually put on the table didn't even cover the amount of the insurance company's lien, not to mention attorney's fees. So we would have ended up with no money and deeply in debt...

All I can say is I am seething....

And can't believe that attorneys (for the defense) will actually look you in the eye and make up lies.

It was a really stressful day.

Tomorrow, our attorney is filing for a court date. Law has it that you can't file for a court date until you have tried mediation.  So we did that and now onto the next step.  Our attorney thinks we might get a court date set for about seven months from now...

And I am glad my sister is still here. Tomorrow, we shall go out and about and will try to have some fun and forget about this crap.

Now, I need to try to get some sleep....

I'm sorry to hear that's the way it turned out. I suspected the defense would probably use what ever delaying tactics they could use, including a ridiculous settlement offer. I hope not, but I wouldn't be surprised if they don't file to push back any court date set, and appeal when they lose the court fight with a major dollar ruling for you and Bob, just to further delay paying out.

Keep up the fight...never give up.
Your strength is amazing in so many ways.

Diane, I agree with Dan that it's a delay tactic (and deflating) to start their bartering at zero. I've heard that many cases aren't resolved until the court date, just before the trial starts, wringing out just as much angst as possible. As though you need more suffering. I'm praying that the defense breaks down and exhibits some humanity pretty soon. You should not be suffering like this.

I concur with Dan and Barb. Wonder if your lawyer can find some way to bring the court date up instead of seven months from now. ??? Frustrated and angry with you. Blaaah. Too, I 'm grateful your sister could be with you. Love ya. Stand firm!
